There is no doubt that evidence by testimony came as a sign that legislator wants to give judges full power to weigh the evidence, unlike the situation in other kind of evidences where the judge is restricted upon a kind of evidence. This article shows that even the law has given wide authority to the judge upon testimony; the extent of this authority differs from legislation to another in different countries according to the adopted principle of evidence. Accordingly, this article has been divided into three sections; the first examines the judge's authority upon evidence by testimony, while the second examine the judge's power to govern the case by testimony without demand from litigants. The third one evaluates such authority in the Jordanian law and other comparative laws such as Arab and foreign laws. Keywords: Jordan, law, court discretion, testimony, evidence..

The present study aimed to identify the reality of the application of knowledge management and its impact on the excellence of institutional performance in Saudi universities: A case study at Najran University in Saudi Arabia. The study utilized the descriptive analytical approach through designing questionnaire used to measure the reality of applying knowledge management in Najran University. Data collected from a sample consisted of (168) faculty members. The study showed that the reality of applying knowledge management in Najran University from faculty perspective was medium, and there is a strong correlation between the requirements of knowledge management and its processes on one hand, and the satisfaction of workers, the learning and the institutional development, and the efficiency of the internal processes on the other hand Some recommendations have been made including the need to make faculty members aware of the importance and concept of knowledge management, supporting the main processes of knowledge management, and overcoming obstacles of applying knowledge management. Michel Foucault's thought and his philosophical research, especially those related to power and its relation to knowledge, resistance and revolution, are still controversial among many scholars and researchers. In fact his thought provokes many reactions, objections and arguments. This study aims at understanding Foucault's vision as well as his model in the analysis of the idea of power. in addition, it attempt to clarify his position and analysis of the Marxist concept of power. The study also shed light on topics such as the physics of power and its opposition to the theory of the right and the legal perception of power. Further, the study will address Foucault's questioning of the axioms that which power was based on, such as the monarchy, dependency and others. To achieve these objectives, the researchers adopted in this study the analytical approach as being the appropriate method for such analysis. The study concluded that the relationship between power and resistance cannot be counted as an antagonistic relationship, as for Foucault, resistance is inscribed within power relations:, i.e., wherever there is power, there is resistance, which means that resistance is never in a position of exteriority in relation to power. In addition, the study revealed that power refers to a relation that change continuously, as power remains hostage to changing conditions and volatile strategies. Furthermore, the study showed Foucault's understanding of the resistance and how it can lead to a revolution. Indeed this is based primarily on his analysis to the nature of power and based on the fact that resistance, according to him, is an alternative model of power, and that resistance is a stage of Slow development towards revolution. This has been tested through the research hypotheses and the search tool has been prepared and distributed to the sample consisting of (60) employee and (41) questionnaire has been collected. The research concluded a set of results:Persuasive leadership practices got a high percentage (78.02%), supporting a culture of excellence and innovation got (76.94%) and there is a positive relationship between the persuasive leadership practices and supporting a culture of excellence and innovation. A proposed framework has been established to depend on its phases for the development of persuasive leadership practices in the Palestinian banks to achieve greater capacity to support a culture of excellence and innovation. Therefore, the researcher recommends the adoption of the proposed framework in the Palestinian banks. Keywords: persuasive leadership, culture of excellence and innovation, the Palestinian banks..

The aim of this study is to analyze wind data in terms of speed and direction in 24 meteorological stations spreading over different areas in Jordan such as Jordan Valley, the Eastern Highlands, and Southern and Eastern Badia. Annual, seasonal and monthly averages of the winds data were analyzed to estimate the density of potential power in every meteorological station. The results show that the wind trends in Jordan are mostly the western trend. This has been found in spring and autumn with a speed ranges between 280-285º and 260-265º respectively. Furthermore, northwest winds were found in summer whereas south-west winds was in winter. The annual average of wind speed in Jordan ranges between (0.7 m/s) in Ghour Al Safi and (5.2 m/s) in Ras Manif. Based on their average of the wind speed meteorological stations in Jordan were categorized into three groups. Based on the seasonal averages, the highest winds speed was in spring season (2.83 m/s) whereas in summer season a slight decrease of wind speed was noticed (2.77 m/s). The situation of wind speed in winter and autumn was (2.48 m/s) and (2.08 m/s) respectively. Regarding the density of potential energy, the highest values was in Ras Muntif (88.1W/m²/h), followed by Aqaba (41.4 W/m²/h), Madabba (35.2 W/m²/h) South Azraq (33.7 W/m²/h), Safawi (32.6 W/m²/h) Amman Civil Airport (22.3 W/m²/h) and Tafileh (21.6 W/m² /h). The density of potential energy in other meteorological stations was less than (20W/ m²/ h).d Keywords: Wind Energy, Renewable Energy, Jordan Climate..

This research is devoted to one of the most important theories of cognitive significance: the theory of mental spaces, as developed by G. Fauconnier [1984] (1994) and (1997) in particular. It is a theory that language is concerned with the building of meaning directly in context; that is, sentences can not be analyzed in isolation from speech. The semantics, traditionally considered to be concerned with the meaning of sentences in context, can not Separated from pragmatics, which means the contextual sense of sentences, and the building of meaning is context-driven and therefore subject to the information of a particular situation. Meaning is essentially a conceptual process. This theory also takes into account the processes and general cognitive principles that contribute to the building of meaning. Keywords: cognitive, language, mental space, context, construction. .
